General Terms and Conditions for KGE Design

1. Introduction

These terms and conditions outline the rules and regulations for the use of our services. By engaging with KGE Design and/or Kenneth G. Elmer, you agree to these terms.

2. Business Information

KGE Design is a sole proprietorship based in Winooski, Vermont, United States. We provide services under the name KGE Design and/or Kenneth G. Elmer.

3. Services Offered

KGE Design offers:

• Trademarking SErvices

• Logo Design

• Branding Element Design

• Concept Illustrations

• Brand Architecture Development

• Digital Operations Development

• E-commerce Development

• Print Design

• Front-end Web Design

• 2D and 3D Illustration and Rendering

Usage Restrictions: All designs are tied to specific projects unless agreed otherwise. Clients may use designs only as intended. Any other use requires prior written consent.

4. Client Engagement

Client engagements must be formalized through a written agreement before any project begins.

5. Copyright and Intellectual Property

KGE Design retains copyright ownership of all original illustrations unless otherwise stated. Clients are granted non-exclusive rights to use designs as outlined in the agreement. Third-party intellectual property remains with the original creator.

Derivative Works: Modifications or adaptations require a separate agreement. Adherence to defined use policies is required if a buyout is requested.

6. Payments and Fees

Payment Methods: Direct deposit, credit card, and PayPal are accepted.

Upfront Payments and Deposits: For projects over $600, a 50% down payment is required before work begins. Large projects may use a retainer system.

Late Payments and Cancellations:

• Late Payments: Work will be discontinued if payment is over 15 days late.

• Refunds: Refunds are not offered.

• Cancellations: Work completed up to cancellation will be billed.

7. Deliverables and Deadlines

Delivery timelines range from 2-3 days to one week. Includes three rounds of revisions; additional revisions are $50 per hour. Minor changes are covered within 72 hours of delivery.

8. Dispute Resolution

Disputes will be resolved through mediation, arbitration, and if necessary, litigation. Jurisdiction will be specified in the agreement.

9. Liability and Indemnity

KGE Design limits liability to the fullest extent permitted by law. Clients must indemnify KGE Design against claims related to design use. Content deemed offensive or inappropriate may be rejected.

10. Privacy and Data Protection

Personal data is collected only to fulfill contract obligations and is not shared with third parties. Our website does not use cookies.

11. Marketing and Portfolio Use

KGE Design may showcase completed projects in its portfolio or for marketing purposes, as covered in the initial agreement.

These terms and conditions apply specifically to trademark development projects. By engaging with KGE Design for these services, you agree to these terms.

2. Trademark Development Process

1. Naming Services:

• Scope: Assist with naming products or businesses or work with existing names.

• Client Role: Provide input or make the final decision on naming.

2. Trademark Research:

• Scope: Conduct basic research through the US Trademark Office and online resources.

• Client Role: Provide necessary information and review findings.

3. Trademark Strategy:

• Scope: Develop a trademark strategy and assess potential conflicts.

• Client Role: Provide information and review recommendations.

4. Visual Component Development:

• Scope: Research and design logos and visual components.

• Client Role: Review and approve design concepts.

5. Trademark Registration:

• Scope: Manage the trademark registration process.

• Client Role: Provide necessary documentation and approve registration.

6. Deliverables:

• Scope: Includes Trademark Assessment Report, Style Guide Document (if applicable), and Logo Design.

• Client Role: Review and approve deliverables.
